INSTALLING TILDE FONT SOFTWARE OR MAKING A COPY OF IT CONSTITUTES ACCEPTANCE OF THE LICENSE AGREEMENT. 1. License Grant In consideration of payment fee, which is part of the price you paid for this Tilde Font Software, Tilde as the Licenser grants you, the Licensee, a non-exclusive, non-assignable, non-transferable right to use this Tilde Font Software subject to all of the terms and conditions of the Agreement. Tilde reserves all rights not expressly granted to the Licensee by this Agreement. 2. Ownership This Tilde Font Software and other materials are licensed to you, the Licensee. As the Licensee, you own the media on which Tilde Font Software is originally or subsequently recorded or fixed, but Tilde and/or its licensors retain title to and ownership in Tilde Font Software recorded on the original copy and all subsequent copies of it. This License is not a sale of the original Tilde Font Software product or any portion or copy of it. 3. Permitted Uses As the Licensee, you may physically install and use Tilde Font Software on up to five (5) workstations at any given moment of time. If you have a multi-user License for this Tilde Font Software, then at any time you may install and use Tilde Font Software on as many workstations as stated on the invoice. You may distribute Tilde Font Software electronically embedded in a document only when Tilde Font Software embedded in such document (a) is transformed into a static graphic image (for example, a "gif") or an embedded electronic document, and (b) is distributed in a secure format that permits only the viewing and printing (and not the editing, altering, enhancing, or modifying) of such static graphic image or embedded document. You may not modify, adapt, translate, engineer, decompile, disassemble, and create derivative works based on Tilde Font software. You may not alter Tilde Font Software for the purpose of adding any functionality which it did not have when delivered to you. You may not change or alter the embedding bits which determine the capabilities of Tilde Font Software. Tilde Font Software may not be used to create or distribute any electronic document in which Tilde Font Software, or any part thereof, is embedded in a format that permits editing, alterations, enhancements, or modifications by the recipient of such a document. You may not convert a Tilde font to a web-font format nor publish it directly or indirectly online unless you purchased a specific license from Tilde. Written materials provided to you may not be modified, adapted, translated or used to create derivative works without the prior written consent of Tilde. You may take a copy of Tilde Font Software used for a particular document, or Tilde Font Software embedded in an electronic document, to a commercial printer or service bureau for use by the printer or service of printing such a document but only if the printer or service bureau represents to you that it has purchased or been granted a license to use that particular Tilde Font Software. 4. Transfer You may transfer all your rights to use Tilde Font Software to another person or legal entity provided that (a) the transferee accepts and agrees to be bound by all the terms and conditions of the Agreement and (b) you destroy all copies of the Font Software, including all copies stored in the memory of a hardware device. 5. Backup You may make one backup copy of Tilde Font Software for your own archival purposes only. Upon termination of the Agreement, you must destroy the original and any and all copies of Tilde Font Software. 6. Termination This Agreement is effective until terminated. This Agreement will terminate automatically without notice from Tilde if you fail to comply with any provision contained herein. Upon termination you shall destroy the written materials, Tilde Font Software and all copies of them, in part and in whole. 7. Disclaimer and Limited Warranty Tilde warrants that Tilde Font Software is free from defects in materials and workmanship under normal use for a period of thirty (30) days from the date of delivery of Tilde Font Software as shown on the invoice. Tilde's entire liability and your exclusive remedy as to a defective product shall be limited to either, at Tilde's opinion, refund of purchase price or replacement of Tilde Font Software returned to the point of purchase with a copy of the invoice. If the failure or dysfunction has resulted from an accident, abuse or misapplication, or if Tilde Font Software is lost or damaged due to fire, theft or negligence, Tilde shall have no responsibility to replace Tilde Font Software or the media, or refund the purchase price. EXCEPT AS EXPRESSLY PROVIDED ABOVE, TILDE FONT SOFTWARE IS PROVIDED "AS IS". TILDE DOES NOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING TILDE FONT SOFTWARE. THE FOREGOING STATES THE SOLE AND EXCLUSIVE REMEDIES FOR TILDE'S BREACH OF WARRANTY. Governing Law This Tilde Font Software License Agreement is governed by the laws of the Republic of Latvia. If this product was acquired outside Latvia, then local laws may apply.
